I just hope the wheels of justice will not lose its true vigor and strict application of the full force of the law no matter how influential the family clan of the accused is. The "headline" is mind-boggling for how can an accused be released from jail if, as what the bottom line of this news suggests, the mother of the accused, according to his lawyer's explanation, is still looking for money to comply with the P100T bail requirement. The account further noted that Judge Emmanuel Carpio of RTC Branch 16, Davao City, granted earlier on March 27, 2012 the petition for bail of the accused after the "court finds no strong evidence to deny his constitutional rights to bail." The crime of rape is non-bailable but the judge may, in his own discretion, decides to grant bail saying there is no strong evidence of guilt. The accused was just recently released on bail on September 27, 2012 according to jail warden Superintendent Isabelo V. Cartin, Jr. The demurer was filed on September 14 by lawyer Heracleo Malaki III, counsel for the accused Datu Naga Mitra Mangudadatu but on September 17, private prosecutor Aimee Torrefranca, lawyer for the rape victim "Victoria," claimed she already filed the necessary documents required by the court and was sent via mail last August 29 yet. The accused who was just released on bail could mean additional headache for the rape victim for he can at any instant intimidate the victim not to pursue the case anymore. There is still a long way to go before our Philippine courts can claim, assume and command the people's respect. 

The early release of the accused as shown here is embroiled with so many questions and doubts from the public because it is common knowledge that in our country if the "accused" is influential the integrity of the judge handling the case could play a big role if he is made of stronger stuff to be able to resist the temptation of the "glare" of money which in many instances is found to be so devastating that it defeats the true and correct interpretation of justice.
