Kaban ni D_BystandeR: DILI MAKABUYLO SI MAHISTRADO SERENO???

Although the Supreme Court is under the stewardship of P-Noy's appointee Chief Justice Ma. Lourdes Sereno, it is under the influence of Justice Antonio Carpio, who lost his bid to become the Chief Justice.

Being a senior member of the "Old Boys Club" of the SC and where  decision is collegial, there is no way CJ Sereno can overturn the rule of the majority regardless of how noble and justified is her innermost conviction to uphold PDAF in favor of Malacanang for the good of the people. The  SC, having declared the use of PDAF and Malampaya funds unconstitutional by the stroke of the pen, has made it illegal for use outside of the provisions mandated by law and is now beyond the reach of Malacanang to help the disaster-stricken Tacloban City and other islands similarly situated in the aftermath of that Super typhoon Yolanda unless the allies of the President will find ways to circumvent the law for the greater good of the people.

And this unprecedented SC decision has put to naught the existence of a law that defined the use of PDAF and Malampaya funds under the discretion of Malacanang for 23 years. They will now look for another ways to source out much needed funds for the rehabilitation of the typhoon-ravaged areas and other badly needed funds to rehabilitate schools damaged by the typhoon.
