Kaban ni D_BystandeR: GANUKOSNUKOS ANG COMELEC SA PAGDUMILI SA MGA BOTANTE

Note: This is in reply to someone who calls himself, "DOM," in connection with comments posted in its "comment portion" in Philstar, with the news entitled, "Supreme Court junks petition vs 'no bio-no boto.'" It came out on December 16, 2015.

I am just curious and concerned as a Filipino that although I cannot vote because I am now residing in the States but I take special cognizance of the fact that the Comelec has been so callously detached, indifferent not to give consideration to a big number of voters - 3M - who will surely be disenfranchised because of their 'no bio-no boto' policy. The big bulk of the 3M voters is such  that we cannot just simply ignore the problem and that something should have been done to solve it instead of totally dismissing them as a "group of tamads." And we should bear in mind that this 'no bio-no boto' is just one of the latest kind of solutions that our Comelec "bright boys" have come up with to deter electoral fraud. Before that there was that kind of "indelible ink" applied to the index finger of a voter so he can be prevented from voting again if he shows up in another precinct to vote because his index finger bore the mark of that indelible ink which cannot be easily taken off. How sure are we that this 'no bio-no boto' will be able to prevent electoral fraud of wide scale proportion like what happened in the "hello Garci" incident in 2004 where GMA was heard over the phone as dictating to a Comelec commissioner to ensure that her majority over FPJ will not be less than 1 million votes?

It is unfortunate that instead of upholding the right to vote as enshrined in our constitution to allow its bona fide citizens their right of suffrage, the Supreme Court has, in effect, allowed itself to be muddled by unpardonable, whimsical and capricious decision adopted by Comelec to disenfranchise an estimated 3M voters, just because of the 'no bio-no boto' policy of the  Comelec. What can the people do if the rules of the game are heavily stacked up against them? And there was the much talked about brouhaha about the "hocus-pocos" of the voting machines which were believed being programmed  to favor the administration's bets by assigning a certain number of percentage for the other party's candidates to assume a degree of acceptance that the  result is, indeed, an honest reflection of the people's mandate.

Kaban ni D_BystandeR: PADAYON ANG KUMBATI TALI NI BISE MAYOR EDGAR UG JOY YOUNG

Vice Mayor Edgardo Labella could not be faulted for holding his position as the incumbent vice mayor right after he was proclaimed the winner in the 2013 election because he was just following how the Comelec did its uncontested proclamation . If it comes out later, as a result of the Comelec recount made in connection with the election protest filed by Tommy Osmena and Joy Young, which was later on withdrawn by them last June 8, 2015, and in which the Comelec has just recently announced that Joy Young garnered 238 votes as against Labella's 59 votes, thereby understood in any language as a winning number in favor of Joy Young, but only that it was not declared anymore as such by Comelec because they have already withdrawn their poll protest. But common sense would clearly point out to no other verdict but victory for Young. But that is now all water under the bridge as Young has already withdrawn his election protest against Labella. And besides, the remaining few months when the recount's result was announced prior to the next year's election points to the futility of the need to assume Young's post and can only be considered with negligible importance. But the fact remains that although not announced by the Comelec but people can still view it as a vindication to Joy Young who lost to Labgella in the early Comelec count but in the end his supporters and followers can still claim that their votes for Young was not all in vain because Young won that election no matter how late the truth was discovered in the poll recount. And this is the most important meaning of this late announcement made by the Comelec as carried by the leading newspapers because it clearly points out that if only the mistake was noticed earlier, Joy Young could have rightfully acted as the Vice Mayor of Cebu City instead of Labella.

Manny Pacquiao, the world boxing icon and presently the man running for a senate seat under VP Binay's UNA, will forever be held in the  people's heart as the man with an understanding and merciful heart,  who continues to rally behind Binay, despite the fact that Binay was  already badly battered by the administration of BS Aquino by subjecting him to a massive "demolition job," unprecedented in the entire political annals of our country, and is known for its unequaled wickedness and  outrageous display of political wrath against Binay, the person who, previously, was consistently topping all political poll surveys as the  front-runner of the 2016 presidential race until the "demolition job" initiated by Malacanang took its toll against Binay and reduced him to nobody like he was the most downtrodden man we can imagine. But Manny Pacquiao could not be tempted to change his treatment to his longtime friend VP Binay. Despite the offers he got from other political party to grace their ticket appearing as their guest candidate to add flavor to their  unpopular party, Manny Pacquiao remained faithful to Binay, and for that, he has won the people's praise for his consistent stand to keep Binay as his true friend at a time when people with passing friendship will just simply desert him and join the offer of the powerful political party in the country today. Mabuhay si Manny Pacquiao for Senator and Jojo Binay for President in 2016 elections!

Kaban ni D_BystandeR: MAY PINALABI ANG PAGPATUMAN SA MASUSPENSO NGA ABUSADO SA GOBYERNO???

This is the most shameful expose showing how the administration of BS Aquino is shamelessly trying to give what we call selective and compartmentalized justice by acting surprisingly very fast in dismissing public officials identified with the opposition but is found "foot dragging" on cases when allies of Aquino and Roxas are involved. Take the case  of Capiz Governor Victor Tanco Sr., a close ally of Aquino and Roxas in the LP who still remained in office 2 months after the Ombudsman had ordered the governor's dismissal on October 22. But DILG officials claimed it had not implemented the order to dismiss him because the Ombudsman  failed to clarify if Tanco's case was covered by "Aguinaldo doctrine." But the Supreme Court had already abandoned that doctrine last month citing  the case of Makati Mayor Junjun Binay as the last public official to have  availed of such doctrine.

Kaban ni D_BystandeR: BALAOD SA AMLC GIPAMOLITIKA???

(Note: This is in reply to a comment posted in the "comment portion" by someone who calls himself, "me_insideout" in connection with a news item in PDI, entitled, "More anomalies in Makati parking building bared." It came out on December 14, 2015).

What is probably unknown to you that as originally envisioned by our lawmakers, AMLC was intended to focus its attention to smugglers, drug syndicates, terrorists and other criminal elements foreseen as formidable threat to our country. But what is the administration of BS Aquino doing right now is to change the direction of AMLC by using it as his powerful tool and weapon to undermine and abuse his power to  unjustly uncover the financial records of his known political opponents and with unthinkable sign that only a man drunk with power can do that, even used his power and influence over, practically, in every government agency that he can lay his hands on just to unjustly expose everything to the media like what was done when AMLC first got hold of what it considers as the first group of business firms and personalities directly or indirectly linked to VP Binay by submitting a copy of its report to media  outlets instead of asking first the concerned parties to verify and get their explanation on some questionable items because they are more knowledgeable to explain it rather  than expose everything to the media with the criminal intent of destroying their reputation by perception. AMLC has, after all, not complied with its intended mandate but is now used  as a tool by Aquino to oppress and persecute his political opponents. But the markings  on the wall soon will be coming closer to him as the clock of his term is fast ticking off by the end June 30, 2016 and by that time he can expect to have a dose of his own  medicine when he faces cases in courts when he finally loses his immunity from suit. By then, he will be just like anybody else who will be made to pay for his criminal  misdeeds while in office just like what happens to GMA that up to now is still languishing in jail without bail.

Kaban ni D_BystandeR: KAHAYAG SA HINABANG MISANGPOT SA MAKAPAIG NGA KATAPUSAN

This is only a possibility that the elderly victim who just received P3,000 cash aid from Cebu City government could be a victim of foul play and needs a deeper scrutiny into his death as a lighted candle being lighted by the victim before going to bed seems shallow and not convincing enough and is only resorted to by the investigators to do away with the long and tedious work if they are to do it with painstaking efforts to determine the truth of his death. And besides, life of a poor victim is not very important to the investigators handling the case. But considering that he was with a group of persons in a drinking spree before going home to his hut at the dump site could have triggered his death if some of those drinking with him have hatched a plan to divest him of his money and to make it appear that  his death is accidental by setting his hut on fire thereby throwing away whatever evidence there was to pinpoint their crime, if any. But we already know that when a poor man dies, there is lack of necessity to dig deeper into its cause as some  investigators would probably choose the easier way to simply dismiss it as  resulting from his carelessness to put off the candle before going to bed. And  besides, the investigators consider it a waste of their time and effort with no  lofty reward on sight from concerned relatives, if any, because the victims is  poor.

Kaban ni D_BystandeR: KAMATAY SA MGA TAMBALAN, BUNGA SA PAGPASAGAD SA PANGAGAMHANAN

The series of deaths of patients in the district hospitals, run and operated by the provincial government, where most of them involved young children according to news reports that points out to physician's neglect, inefficiency and medical malpractice, have only positively energized the most notable critic former Gov. Gwen who suggested that it could not be caused by political detractors as claimed by Gov. Davide as the reason for their deaths speaks for itself. It could be remembered that I have, in several instances in the past, tried to make some unsavory comments with how she ran her administration but that has nothing to do with cases like this, because it involves a controversy about the deaths of patients in district hospitals. I find the points raised by Gwen as something that stirs the conscience of some keen political observers to be reasonable and thought provoking.

(Note: This is in reply to someone's post in the "comment portion" who calls himself , "bisdak," in connection with a news item in Cebu Daily News, entitled,"DILG serves Rams's suspension order." It came out on Dec. 12, 2015.)

Ayaw lang sab ug palab-ani kay dili baya sayun hunahunaon ni Mayor Mike Rama nga kaniadto nagtuo siya nga wa nay makapugong niya tungod sa iyang gihuptang gahum isip mayor sa syudad sa Sugbo diin didto siya  nasayup kay imbis iyang ipaagi sa korte ang pagpaguba sa center island sa karsada sa barangay sa Labangon nga gidumala sa karon iyang giisip nga kaatbang sa politika kay usa na man siya sa molansar nga kandidato sa BOPK sa pagka-konsehal, iya na man hinoong gipakita nga way makapugong niya kay siya maoy labing hawod sa tibuok syudad sa Sugbo. But it's too late for him to repent because the damage has already been done. Poor Mike Rama has to suffer for the consequency of his lack of moral foresight of the legal implications of his actions.

Kaban ni D_BystandeR: PIGADO SI BISE MAYOR LABELLA SA KASUNGIAN SA KONSEHO SA DAKBAYAN SA SUGBO

I cannot imagine that Vice Mayor Edgardo Labella, who was the former director of the Office of the Ombudsman before he was elected as a public official, can be under the influence of the political ramifications about the insistence of Team Rama to have the SB-1 approved by the city council. And it cannot be denied that the motive behind their insistence is politically motivated considering the several instances in the past where the city council asked the finance officers to join them in their discussion to resolve the impasse about the SB-1 but Mayor Mike strongly prevented his people to submit to such kind of wholesome alternative to find a solution to the problem. And now, here comes VM Labella who wanted the office of the Ombudsman to interfere into this kind of internal squabble inside the city hall which is clearly politically motivated. And it was still fresh in the minds of the city residents as to how Mayor Mike squandered the precious taxpayers money to  buy a fleet of brand new vehicles costing a hundred million pesos to the city coffers just to bribe the loyalty of the mountain barangay captains in order to win their votes in the last election. Activities like this which is possibly intended to take place just to win votes is probably the reason why the council strongly refrained from voting on it. And with the other option presented by the council to solve the impasse that was blocked by Mayor Mike, it would appear that VM Labella's call for the Ombudsman to interfere is practically uncalled for and is ill-advised.

Kaban ni D_BystandeR: MAY PINALABI ANG ASUNTO SA HUKMANAN???

I find the MR (Motion for recon) justified and reasonable as it tries to differentiate the common belief that the Council's resolution authorizes Mayor Mike to sell Lot No. 8 or a portion of the SRP when in fact it runs counter to the city ordinance which prohibits the sale of the lot is not to be misunderstood as the implementing tool of the original city ordinance. The ordinance should either be amended or that another ordinance be crafted to expressly support their desire to sell it. But I doubt if the judge handling the case will listen to the arguments presented in the MR considering that this judge is known to have been very fond of handling favorable decision to the city every time there is a case filed against the city government of Mayor Mike. And I will not be surprised why this judge always gives a favorable decision to the city because viewing how Mayor Mike has strongly batted for a higher monthly stipend to the judges in the city before and it only follows that some of the judges made it a point to reciprocate to the "kindness" of Mayor Mike to them. That is why when DOJ Secretary Leila De Lima earlier touched on the case of abolishing the monthly allowances given by LGUs to the judges before, I was thinking that if that was only carried out, perhaps the public perception to expect an honest-to-goodness decision from the judges for every case that they handle pertaining to the LGU concerned could be possible because there is no other compelling reason for them to be subservient in their decision to please that LGU to tinge their decision with their personal feeling to reciprocate for the token of "kindness" that they received.

Kaban ni D_BystandeR: MAY TSANSA BA SI "DIGONG" DUTERTE???

The reason, I believe, why Duterte was taking it too long to file his candidacy could be a matter of a shrewd political strategy which only a man with smart ideas like him can think of it. He is surely not the "teka-teka" type being referred to by the author for his background as City Mayor of Davao does not reflect him to be employing that kind of disdainful and undesirable trait. When he says he wants his plan like this to clean the city of criminal elements, he trumpets his warning loud and clear and there is no room for another option given to the criminals to leave the Davao or they will change their birthdays to Nov. 2 - "All Souls Day." And don't you know how much Duterte has done to ensure his possibility of winning the presidential race by not filing on time his COC last Nov. 16? He has so popularized himself without spending a single centavo in any political ads and everybody agrees it was a brilliant stroke of him so that by the time he made a decision to file his candidacy by substitution - a scenario made legally possible by COMELEC rules - he instantly became the No. 1 in poll survey, a feat only a man of his caliber, fame and stature can expect to achieve. By any analogy, nobody can beat the fact that Duterte is, by far, already a name brand the people wants to elect as our next president in 2016. Want to bet?

Kaban ni D_BystandeR: DUGUONG PANGHITABO SA MAGUINDANAO, GIKALIMTAN UG GISURAMBAO???

Six years have passed since the horrible massacre of 58 people including 32 media practitioners took place in Maguindanao but, sad to say, until now nobody is convicted despite the glaring facts that the masterminds were positively identified by a hundred witnesses and this, despite the promise of BS Aquino to give justice to the massacre victims before his term ends in June 30, 2016. But Aquino could not have been helpless to give justice to those massacre victims if we are to consider that he even succeeded in ousting CJ Corona from the SC which is viewed by many observers before as quite a difficult task to accomplish. Aquino even succeeded in toppling downthe once considered politically invincible VP Binay from his consistent top spot in different poll surveys for the 2016 presidential race until the powerful "demolition job" orchestrated by BS Aquino against  Binay forcefully changed everything using his unlimited power and influence over BRSC to conduct non-stop and monotonous senate inquiries which lasted for more than a year wasting the taxpayers money when the series of senate inquiries could have been utilized to craft meaningful legislative agenda to solve the unemployment problem of the country resulting in 6,000 a day of people leaving the country to work as OFWs  abroad in search of decent jobs which the Aquino government failed to provide. And what is definitely shameful in the manner he toppled Binay's popularity was by using Aquino's power to influence the government agencies concerned like AMLC, the Ombudsman, etc., just to see to it that Binay will no longer look threatening to the candidacy of his political protege, Mar Roxas. And Aquino is doing those things to prove that he has the power and influence to get what he wants. But when it comes to the most important thing about giving justice to the people who were crying for his help, that is where he sadly failed. Take for instance the case of the unsolved killings of the lumads in Mindanao where from 2010 up to a month ago as reported by the Inquirer, 58 of their community leaders were already killed allegedly by paramilitary units coddled by the military. And the lumads have already gone to Manila even at the height of the APEC convention just to dramatize their urgent demand for justice for the deaths of their own people asking for help from Aquino. And if he cannot give justice to the lumads, how much more to the 58 Maguindanao massacre victims whose killings in broad daylight was masterminded by a very rich and influential family of the Ampatuans. And proof of this is the fact that Sajid, the youngest son of Andal Ampatuan Sr., who died a few months ago during the trial of their case, was able to post bail of P11.6M despite the fact that it is a heinous crime and hence non-bailable. And Sajid is now even reported to have already filed his certificate of candidacy (COC) to run for mayor in his town.

Kaban ni D_BystandeR: GIPAKAUWAWAN NI KAREN SI ALMA MORENO???


There are only two sides of the arguments and it's either we praise and defend Karen Davila in her way of propounding questions to Alma Moreno or we have to condemn her in her kind of "Alma-bashing" interview. But with the explanation made by the author, Dolly Carvajal, who is also, herself, a talk-show host, one can easily see that Karen has overstepped in her prerogative as a program host interviewer because she was only concerned of how she appears to her TV viewers nationwide but was negligent of how the interview will affect Alma to embarrass her endlessly. And Alma was not supposed to get a beating herself by submitting to that kind of interview. She ought to deserve a little sense of respect from the interviewer. Just because Karen finds Alma running for senator does not entitle her  to insult and embarrass Alma before the public. And Vandolph was right to express his disgust, indignation and repugnance to Karen's way of humiliating his mom. And I don't think Karen is that dumb not to have imagined a backlash she creates on the person of Alma with the way she carried out the interview. Sensing that Alma is not that good and articulate in answering her questions, Karen should have made some necessary adjustment to her mode of questioning so as not to project an image of her subject interviewee in an embarrassing situation. But  Karen appeared clueless. All she did was to slam Alma with those complicated  questions obviously trying to embarrass Alma by letting her explain even to the minutest detail the answer to her question. All in all, Karen was a failure as a talented interviewer; she should have known better!
