If we are to check and verify the
different cases now pending in courts which ultimately resulted in overcrowding
of jails, what came out in this news could only be a sample of the many
injustices committed by man to his fellowman on account of the poor status of
the other oppressed party who has no means to hire a competent lawyer to defend
him. Some of those now in prison are already overstaying more than what their
infraction requires them to stay in prison. Take for instance the case of one
Jovito Carcela, 74, of barangay Cabagdalan, Balamban, Cebu who was thrown to
jail only at first because he was "invited" by the police but it
turns out he was then and there put in prison because his neighbor has already
filed a case against him. He was accused of cutting 100 coconut trees, which
according to him falls under the piece of land that he owns. And when he was
about to finish serving his jail term, another one was filed against him by the
same person accusing him of transferring the land marks made of round cemented
posts which his neighbor deliberately did but accused him as the one doing it.
This is the height of injustice
committed by an evil-minded neighbor who exploited his being a poor man with
nobody to turn to for help. The town officials of Balamban should do something
to help this poor old man who is still languishing in jail because he doesn't
have the means to hire a lawyer to defend him against his probably rich and
influential neighbor.
