There is a legal interpretation
presented by former IBP-Cebu Chapter president lawyer Michael Yu to the effect
that the 50-year contract lease in the establishment of the Parian Drop-in
Center is authorized to the Children of Cebu Foundation and not to its
chairperson Councilor Margarita Osmena. But his legal view cannot be solely
accepted or relief upon as gospel truth because there are two sides of the coin
and it is always held that a lawyer's opinion even though coming from a former IBP
president cannot be considered a deciding factor into entertaining another
school of thought that the present chief executive, Mayor Mike Rama, can just
simply ignore the existing contract even though the chairperson who signed the
original contract is still alive and kicking. The idea that she can just be
ignored for whatever value that she still holds with the contract if Mayor Mike
wants to impose drastic changes to it is debatable. The opinion given by Yu to
favor Mayor Mike is explicitly awash with his partisan leanings and does not
command a healthy sign to be given any credence at all to fully address the
issue as embraced by the real context of the contract.
