The receipt of a letter dated August 28 from Cebu City election officers Marchel Sarno and Edwin Cadungog informing the petitioner former Rep. Tommy Osmena and defeated mayoral candidate of Cebu City on Sept. 2 or just one day before the contested ballots were to be sent to Manila is questionable as it sent Tommy scrambling within the limited time left to send his representatives from his BOPK party to the place pointed out in that letter. That enabled his representatives to find out the "mishandling of ballots."

It could not be immediately known what caused the "discovered problem" as Ferdinand Gujilde, head of Cebu City board of canvassers and the south district election officer during the May 13 election, "could not be reached for comment." If team Rama is confident of their victory as what they claimed to have won in the last polls, something seemed to be amiss to be not in line with "reality" as it would somehow appear there are some "invisible hands" that tried to make things difficult for Tommy, on the petitioner's side, what with the letter notifying him that just arrived one day before the "contested ballots" were to be sent to Manila and  the limited time given to them to effect the last minute "corrective measures" to see to it that the "ballots in question" that were placed in clustered precinct 410 "still had to be picked out" so that same could be included in the ballots sent to Manila.
