Instead of waiting for the 60-day-period to lapse for a suspension order received from  the Capitol, Dumanjug Mayor Nelson Garcia chose to file a civil petition for certiorari before RTC in Cebu City against Gov. Jun Davide and Dumanjug Vice Mayor Efren Gica.

Still brandishing the same kind of reaction their family was known to hastily resort to filing a case in court whenever they find their propensity to cross the line of making a legal breach is repulsed, it seems they don't have the inclination to mend their ways believing they still have the same clout when former Gov. Gwen was at the height of her power and influence especially during the time of GMA. Not convinced that what he did was clearly understood to usurp the powers of the vice mayor to appoint the municipal secretary, the suspended mayor still cling to his false belief that he can still do whatever he wants and to hell with whatever legal restraints that would have compelled him to observe fairness to his vice mayor.
