The objections raised by Atty. Guiller Ceniza relative to this recount is a valid argument. The result of the recount conducted on the first batch is not truly conclusive and reflective to answer for the questions asked by Atty. Ceniza as the Head of those who was tasked to conduct the recount - Tranni Ferrer, Clerk of court of RTC Branch 55 - pointed out that he was not at liberty to entertain the complainst raised by Ceniza because his duty is only to conduct a recount. In other words, when it was asked how come out of 788 who actually voted only a total of 531 votes were accounted for, Ferrer could not answer for the missing ballots being asked.

Funny! The Clerk of court was asked by uino's counsel about the allegedly missing ballots. Of course, the Clerk cannot answer the question because it is the COMELEC that handles the ballots and its custodial matters. The Clerk was just tasked to count what is inside the ballot box which is deemed authentic by virtue of the presumption that it was sealed by the COMELEC, turned over to the Municipal Treasurer of Compostela, and then to the court. And more preposterous because instead of Wagas' counsel that should have asserted to the authenticity because they are the protestant, it was the other way around in conclusion, the act of Quino's counsel to object to the proceeding due to the alleged missing ballots is tantamount to confirmation of Wagas' case that the election was rigged.

Your claim that Wagas' counsel should have taken the opportunity to present questions relative to that ballot recount as ordered by the court does not make sense because the result of that count was in their favor. The question propounded by Quino's counsel was all the more justified and meritorious because the answer if any could have probably supplied the "missing link"
